These Terms and Conditions ("Terms") govern your access to and use of the BrainScript website, online course platform, and all related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

• "We," "Us," or "Our" refers to BrainScript and its operators.

• "You" or "User" refers to any person accessing or using the Platform, including students enrolled in courses.

• "Course" means any digital educational content, materials, videos, or resources provided on the Platform.

• "POPIA" means the Protection of Personal Information Act, 4 of 2013 (as amended).

You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform.

By using the Platform, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

• You may need to create an account to access certain features, such as enrolling in courses.

• You agree to provide accurate, complete, and up-to-date information during registration and to keep it updated.

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• Notify us immediately of any unauthorised use of your account.

• Upon successful purchase and enrolment, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Course for your personal, non-commercial educational use only.

• This license is for the lifetime of the Course on the Platform (or as long as we continue to offer it), unless revoked for breach of these Terms.

• You may not download, copy, share, modify, distribute, sell, or otherwise transfer any Course content without our prior written consent. All intellectual property rights in the Courses remain with us or our licensors.

• All prices are in South African Rand (ZAR) unless otherwise stated and are subject to change.

• Payments are processed through secure third-party providers. You agree to provide accurate payment information and authorise us to charge the selected payment method.

• You are responsible for any applicable taxes, duties, or fees associated with your purchases.

Due to the digital nature of our products and the immediate access provided upon purchase and enrolment, all sales are final and non-refundable. Once you have accessed or downloaded any part of a Course, you acknowledge that the service has commenced and no refunds will be issued for change of mind, dissatisfaction, or any other reason, except where required by applicable South African law (such as in cases of material defect or as mandated by the Consumer Protection Act, 68 of 2008). We encourage you to review course descriptions, previews, and our free introductory materials carefully before purchasing.

• Use the Platform for any unlawful purpose or in violation of any applicable laws, including POPIA.

• Copy, reproduce, distribute, or publicly display any Course content without permission.

• Attempt to gain unauthorised access to any part of the Platform or interfere with its operation.

• Upload or transmit any harmful code, viruses, or disruptive content.

• Harass, abuse, or impersonate other users or our staff.

• Share your account login details with others.

We reserve the right to suspend or terminate your account immediately for any breach of these Terms.

All content on the Platform, including Courses, text, graphics, logos, and software, is owned by or licensed to BrainScript and protected by South African and international copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any rights to our intellectual property except the limited license described above.

The Platform and all Courses are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

We make no representations or guarantees regarding the accuracy, completeness, or outcomes from using any Course. Results from our courses depend on individual effort and application.

Our total liability to you shall not exceed the amount you paid for the relevant Course in the 12 months preceding the claim.

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your use of the Platform, or your violation of any rights of another party.

Your privacy is important to us. We process personal information in accordance with POPIA. Please refer to our separate Privacy Policy for details on how we collect, use, and protect your data. By using the Platform, you consent to such processing.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform with a new effective date. Your continued use of the Platform after changes constitutes your acceptance of the revised Terms.

We may terminate or suspend your access to the Platform at any time, with or without cause, including for breach of these Terms. Upon termination, your right to access Courses will cease, and any outstanding payments will remain due.

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

You agree to attempt informal resolution before initiating legal proceedings.
